I cannot recommend Ben at TPWC highly enough

I cannot recommend Ben at TPWC highly enough. Ben stepped into what was a quagmire of a situation in an ongoing dispute, having had a previous surveyor let us down. Unlike my previous experience of party wall surveyors being extremely fee (rather than results) focused, he was a complete tonic, knowledgeable and strategic in his evaluation of the situation. He has a professional and friendly manner and was extremely balanced in his approach, looking at a situation from multiple angles. He is focused on reaching an amicable and speedy settlement and has proved to be a god send. I’d recommend him and his team for any one needing the services of a party wall surveyor - they are experienced, professional, pragmatic and straight talking - a rare combination!

Unprofessional and egotistical if you dare to ask questions about liability

The PWC contacted us when our neighbours embarked on a rather large extension and advised that our 100 yr old party garden wall was at risk of damage during the works in which they had to dig new foundations. We engaged in the process and agreed to let works commence as long as they were being reviewed by PWC in an independent capacity. Ben surveyed the existing condition of our properties and we signed to give our permission for works to progress. During the works, only a few months later, a few meters of the garden wall crumbled. Without inspection in person, by photo only, Ben wrote to us advising that the cause was unlikely to be the works. We were baffled and queried how this determination was possible by photo only and we also questioned ownership of the wall and agreed to the suggested zoom call.
The response we received was egotistical and unprofessional. Ben did not like that we had asked such questions and said he would not be our surveyor because we thought him biased and that he had been pre-judged. We were blown away by this reaction. Apparently we should have just accepted that we needed to pay for the remedial works without identifying the cause or ownership of the wall! We should not have asked questions or protected our interests! We have not responded because we will indeed appoint our own surveyor.

Thank you for taking the time to leave a review. I appreciate there is damage to your garden wall, and I understand this will likely be a stressful time. I do believe you have omitted important information and misrepresented the facts.

On the 3rd April I wrote to you with a four point plan. I proposed that we needed to:
1. Establish the cause of the damage.
2. Decide on who is responsible for repairing the wall. We also needed to establish who owned the wall.
3. Arrange a zoom meeting, or a site visit.
4. I recommended a very good bricklayer who could attend site with me.

I stated in this email that I was able to share important evidence in the zoom meeting, and that this would include videos and photos. My hope was that we could progress matters, working together.

On 19th April, I had not heard from you, so I decided to check in. You responded promptly stating that I was 'very biased' and 'not independent at all'.

I stated I would step aside as your surveyor. It is vital that when there is a dispute, all sides have faith that the dispute is handled fairly. By stepping aside as your surveyor, I allowed you to appoint another in my place, and I do hope that this will restore your faith in the process.

Some points that I need to make to give your review some more balance:

1. The walls on BOTH sides of your garden are in need of repair.
2. The section of collapsed wall is over 10 metres from where the extension was built and next to several trees and bushes. This is outside of the normal sphere of influence when it comes to damage from excavation. The excavation was not particularly deep, and the Party Wall Act is invoked if you dig within 3 metres of the wall. There is a good reason that the Act is invoked when excavating within 3 metres - because there is a risk of damage, however, you do not need to serve notice if digging within 10 metres of a structure / wall, for good reason - damage is not thought to be reasonably possible past 3 metres (there is the 6 metre rule too but that is generally for piling and much deeper excavation - even this doesn't stretch to 10 metres!).
3. The wall next to the extension has not collapsed, and indeed, you have to walk more than 10 metres past the end of the extension to get to your damaged wall.
4. The foundations to the extension had been laid many weeks before the wall at the back of your garden collapsed. To attribute this to the excavation becomes increasingly difficult.
5. Whilst the wall may be over 100 years old, I believe it has previously collapsed. There are newer red bricks which were added to the wall, where the collapse occurred, and I believe cement mortar was used. This would not have been good for the brick wall which would have used lime mortar.

I welcome scrutiny, hence why I offered a free zoom meeting. I expect my decisions and thoughts to be challenged, and I was genuinely looking forward to assisting you so that you could understand what had happened and why. I do not think you needed to say that I was 'very biased' just because I had a viewpoint that wasn't aligned with you. I take pride in being able to 'straight talk' which involves giving my own independent and honest opinion.

I understand the matter remains unresolved, and I still await contact from your surveyor. Ideally, this should have sorted swiftly and fairly, but I do appreciate a reset was needed. I am sure that whoever you appoint will come to the same conclusion as me, and sadly this will likely cost you in fees which were avoidable. I understand you will retain this review, even if it is found my actions and thoughts were correct and rational. I also see that you have only ever written negative reviews, so I take this one on the chin, and I trust my response now gives some context.

Very smooth process

TPWC were recommended by our building firm and were a pleasure to deal with throughout. Thankfully our neighbours were happy to consent, but the process, management and level of communication was fantastic. Thank you Alana and Ben.

Great service

I used this company to serve a party wall notice. This was a free service. As the works commenced, I needed to contact Ben and his team for on going advice which was provided robustly, and free of charge. Not knowing much about the building industry, it is really reassuring to have people like Ben and his team to genuinely want to guide and help. What a great company and team!

Ben provided excellent advice

Ben provided excellent advice recently in regards to an issue that was raised with regards to our recent loft conversion. He explained in simple terms the best way of dealing with the matter and has provided a letter on request which will be given to our neighbours to allay any concerns they may have had.

Incredible service!

During the planning of our extension in 2019, TPWC were very helpful in identifying our neighbour and serving notices, all without fee. We then postponed the project during the pandemic, only re-starting it recently. Again TPWC served notices and communicated with our neighbours without fee, and when the neighbour dissented to the work and appointed their own surveyor, TPWC suggested we instruct the same surveyor to save having to pay them in addition to the neighbour's surveyor. This saved us a total of £930 and TPWC didn't charge us a penny, despite guiding us through the process. I am incredibly grateful, and would not hesitate to recommend them to anyone needing a party wall agreement.

Two excellent experiences with Ben…

Two excellent experiences with Ben Mackie. Pre covid he was most helpful and responsive when neighbours adjoining the property I work in appointed him. In June/July 2022 Ben and The Party Wall Collective were very professional in handling a party wall dispute with builders planning work on the house adjoining mine.

Very poor service

I used this firm three years ago, recommended by my loft company, when I had a loft extension built and they drew up the party wall agreements with my neighbours. No issues arose relating to the party walls. Then, when one of my neighbours embarked on their own extension at the end of last year, they opted to use TPWC also. Problems arose when the neighbours' builder started work before the PW agreement was finalised and which departed from the submnitted architects' plans. TPWC had to issue me with a provisional award in the event of problems arising. The builder's work has since given rise to worrying issues for my neighbours and they sacked him. Also, issues have emerged on my property. TPWC were originally helpful and said they'd follow up but have gone silent and have not responded to my follow up emails and telephone calls. I have sought advice and been advised that they carry liabilty as part of the paid for service and are responsible for surveying the work and arranging any necessary repairs on my side. I am now going to have to raise complaints with RICS.

Very helpful advice from Ben and PWC

Very helpful advice from Ben and PWC. I did not actually use them to conduct survey as instead used an agreed surveyor suggested by adjoining neighbour, but Ben still provided good advice and support for me to understand that process

The Party Wall Collective are amazing!

The Party Wall Collective, with Ben handling our matter, provided truly invaluable and specific knowledge, guidance and support - handling a long-running, challenging dispute, to its positive resolution.

When we received a Party Wall notice following the purchase of the house next door by a property developer, for ease and to keep costs low for their project, we initially considered sharing their appointed surveyor. However, after further consideration, to avoid any potential conflicts of interest, we elected to use an independent surveyor.

We had no idea who to contact, so consulted with a highly rated company who did our loft build a few years prior. They recommended The Party Wall Collective, so I got in touch.

Having never been through the process before, they explained everything to me and meticulously documented all relevant areas of our property and ensured a comprehensive agreement was signed, covering all necessary detail.

Regretfully, during the course of the build, the developer caused damage to our property. After agreeing a schedule of works with the developer for our property to be repaired, there was no action. When pressed further, poor attempts were made at repair, which lead to further damage and the repair work needing re-doing.
After a long time trying to find a resolution, we needed a way to force an end to the matter.

The Party Wall Collective advised on all options available to us and then took over the handling of the matter directly with the developer.

It was a difficult case to to deal with, but with their knowledge of the legalities and processes around The Party Wall Act, were able to persist to bring about a just resolution to what had been a burdensome issue.

For this, I can't thank Ben and The Party Wall Collective enough.
